🐕 SERVICE DOG LAWS IN THE UNITED STATES

(Americans with Disabilities Act – ADA)

Service dog rights in the United States are protected under the Americans with Disabilities Act (ADA), a federal civil rights law that prohibits discrimination against individuals with disabilities.

The ADA is implemented through federal regulations, including:

🐾 Definition of a Service Dog

Under the ADA:

A service animal is a dog that is individually trained to perform tasks for a person with a disability

Examples of qualifying tasks include:

    🏢 Public Access Rights

    Under the ADA, service dogs are allowed in all areas open to the public, including:

    • Restaurants
    • Stores
    • Hotels
    • Hospitals
    • Government buildings

    Even in places with “no pets” policies, service animals must be allowed.

    If it is not obvious that a dog is a service animal, staff may only ask:

    1. Is the dog required because of a disability?
    2. What work or task has the dog been trained to perform? 

    🚫 They may NOT:

    • Ask about your disability
    • Request medical records
    • Require proof or certification
    • Ask the dog to demonstrate tasks

    ⚖️ When a Service Dog Can Be Removed

    A service dog can only be removed if:

    • The dog is out of control, OR
    • The dog is not housebroken

    Even then, the person must still be allowed access without the dog. 


    🦮 Handler Responsibilities

    Service dogs must:

    • Be under control (leash, harness, or voice control)
    • Be well-behaved in public
    • Not pose a direct threat

    Handlers are responsible for the dog’s behavior at all times.

    Interfering with a service dog team may violate federal disability rights law.

    The ADA requires businesses and public entities to make reasonable modifications to accommodate individuals with service animals.
